Terms of Use

The Smart Prop Trader website (the “Site”) is comprised of various web pages operated by

Smart Prop Trader LLC is located at www.smartproptrader.com. Use of

www.smartproptrader.com constitutes your agreement to all such Terms. Please read these

terms carefully and keep a copy of them for your reference. These Terms are governing for all

services and products provided by Smart Prop Trader.

Electronic Communications

Logging onto www.smartproptrader or sending emails to SPT is defined as electronic

communications. You consent to receive electronic communications and you agree that all

agreements, notices, disclosures and other communications SPT will provide to you

electronically.

Funded Account Terms

Funded accounts are subject to 1:30 FOREX leverage, as is industry standard for live accounts.

All other instrument leverages are subject to SPT’s discretion and what is deemed reasonable

SPT’s risk management policies.

Additionally, all traders have a max allocation of $400K capital for all Standard Accounts,

and an additional $400K capital for all Pro accounts. Therefore, all traders are subjected to a

max capital allocation of $800K, with $400K of capital being allotted to all Standard accounts

and an extra $400K of capital allotted to all Pro accounts.

international Users

Service is operated and administered by SPT from our offices in Wyoming. If you access the

Service from a location outside the USA, you are responsible for compliance with all local laws.

Breach of these Terms or laws in any way may lead to immediate termination of all accounts

associated with our services, and no refund or payment of any kind shall be issued. In addition,

you may be held civilly and/or criminally liable if you are in breach of these Terms and relevant

laws.

Indemnification

You agree to indemnify, defend and hold harmless SPT, its officers, directors, employees,

agents and third parties, for any losses, costs, liabilities and expenses relating to or arising out

of your use of or inability to use the Site or services, any user postings made by you, your

violation of any terms of this Agreement or your violation of any rights of a third party, or your

violation of any applicable laws, rules or regulations.

Termination/Access Restriction

SPT reserves the right to terminate your access to the Site and the related services or any

portion at any time, at any point in time, without notice. Use of the Site is unauthorized in any

jurisdiction that does not give effect to all provisions of these Terms, including, without limitation,

this section.

KYC

Customers eligible to graduate to a funded account are required to successfully complete the

KYC (Know Your Customer) process through our third-party partner, Sumsub. Customers must

review the required supporting documents listed for their country of operation on the following

webpage: https://sumsub.com/supported-documents/

Failure to successfully complete KYC will result in termination of a customer’s account, forfeiture

of any expenses paid to participate in Smart Prop Trader’s challenges, and a ban of your

account from future use of Smart Prop Trader’s platform and services.

Changes to Terms

Smart Prop Trader reserves the right, in its sole discretion, to change the Terms under which

www.smartproptrader.com is offered. The most current version of the Terms will trump all

previous versions.
